首先我们要认清一个事实,那就是电子邮件辞职有没有法律效力,可不可以视为书面通知?

电子邮件辞职可视为书面通知。

但是你需要做:

1、你的电子邮件必须进行公证;

2、必须有证据证明收件人系单位;

3、必须有证据证明发件人是你。

【辞职报告格式】

(一)辞职报告标题

在辞职书第一行正中写上辞职书的名称。一般辞职书由事由和文种名共同构成,即以“辞职书”为标题。标题要醒目,字体稍大。

(二)辞职报告称呼

辞职书要求在标题下一行顶格处写出接受辞职申请的单位组织或领导人的名称或姓名称呼,并在称呼后加冒号。

(三)辞职报告正文

辞职书正文是辞职书的主要部分,正文内容一般包括三部分。

案 例:

王小姐是一家广告公司的销售主管,由于在一笔销售提成款的问题上与公司产生分歧,她一气之下于2009年4月20日向公司发送了一封电子邮件: “我决定今天辞职,希望公司可以安排交接人员于5月19日前将我的工作交接完毕。”人力资源部门直到5月10日才作出接受辞职的答复。王小姐十分意外,本以为公司会挽留她,没想到公司竟然同意了自己的辞职请求。深感懊悔的王小姐向当地劳动争议仲裁委员会提出仲裁申请。她认为,电子邮件的辞职申请只是自己一个意向表示,应当是书面申请才能构成正式的辞职信。公司发出的这一决定显然是单方面终止与自己的劳动关系,因此要求公司继续履行原劳动合同。

那么,电子邮件的辞职申请具有法律效力吗?辞职申请以什么形式最合适? 分 析:

电子邮件作为即时通讯的一种形式,具有证据特点中的 “关联性”。通过技术手段获取,或者通过公证机关对电子邮件内容及源代码等进行公证取证,电子邮件就具备了证据的 “客观性”与 “合法性”。具备了 “三性”的证据在法律上具备合法效力,也可以在诉讼中作为证据使用。本案中,王小姐在邮件中明确作出解除劳动合同的意思表示,自此意思表示送达公司时即产生了法律效力。因此,王小姐的这封邮件完全可以起到书面辞职申请的效力.

根据 《劳动合同法》的规定,员工提出解除劳动合同的,需要提前30天以书面形式通知用人单位,无需用人单位批准,30天后劳动合同即可解除。王小姐的邮件在到达公司或者公司作出回复之前,她并未作出任何修改或者撤回的行为,因此,即使公司没有在5月10日发出批复,王小姐的辞职决定也将在5月20日产生解除劳动合同的法律效力。

需要注意的是,如果用人单位在规章制度中规定了辞职必须向公司提供纸质书面申请书或辞职信,那么以收到员工发送的电子邮件就认定双方劳动合同已经解除,对用人单位来说可能会存在辞职手续不完备的风险。

另外,作为电子邮件辞职申请这一尚需探讨方可认定其效力的解除劳动合同方式,用人单位应当在收到电子邮件时及时作出反应。如果用人单位不能马上决定的,应要求员工提交纸质并具有亲笔签名的辞职信。在此推荐一种较为稳妥的辞职方式,即要求辞职员工签署公司制作的辞职协议文本,文本中载明离职流程、离职时员工可领取的全部费用、公司扣除社会保险和个人所得税以及其他公司有权代扣代缴的费用、员工须遵守的保密和竞业禁止义务、所有公司物品已交接完毕的承诺以及劳动关系解除的确切日期等内容。
